When Can You Get a Temporary TABC Permit?

Planning an event with alcohol and wondering whether a temporary permit is an option? Many hosts assume anyone can grab a one-time permit for a wedding, party, or fundraiser. Texas doesn’t work that way. Knowing when you can get a temporary TABC permit saves you from planning around an approval you can’t get.

Short answer: You can get a temporary TABC permit in two situations: you’re a qualifying nonprofit running a special event, or you already hold a TABC retail license or permit and want to sell at a location outside your licensed premises. TABC doesn’t issue temporary permits to individuals or businesses with neither. Apply at least 10 business days before the event.

The Two Situations That Qualify

TABC’s own FAQ says you can’t get a temporary permit to sell alcohol unless you hold a retailer permit or represent a nonprofit. That leaves two paths.

1. You’re a qualifying nonprofit. Certain nonprofits can get a permit to sell or serve alcohol at a special event held away from any TABC-licensed premises. Fundraisers, galas, and community festivals are the classic examples.

2. You already hold a TABC retail permit. A bar, restaurant, or caterer can request authority to sell at a separate location for a temporary event, such as a festival booth or an off-site party.

Who Doesn’t Qualify

You generally can’t get a temporary permit if you’re:

  • A for-profit host with no TABC permit
  • A private individual planning a wedding or birthday party
  • A new business waiting on its first TABC license
  • A mobile bar or pop-up with no permit behind it

If that’s you, you have other legal options, and our TABC Licensing team can help you pick one. You can hire a licensed caterer, work under a qualifying nonprofit’s permit, or run a dry-hire setup where the host supplies the alcohol. Our guide on temporary event permits explains how those arrangements work.

Which Temporary Authorization Fits

AuthorizationWho It’s ForWhen It Applies
Nonprofit Entity Temporary Event Permit (NT)Qualifying nonprofitsSpecial events away from licensed premises, up to ten consecutive days
Temporary Event Approval (TEA)Existing license or permit holdersOff-site events that don’t meet the notification rules
File and Use Notification (FUN)Certain existing permit holdersQualifying events where TABC pre-approval isn’t required

TABC sets the exact criteria for each, so confirm which one your event fits before you file.

Events That Commonly Qualify

  • Charity fundraisers and galas run by a qualifying nonprofit Festivals, farmers markets, and community celebrations Auctions benefiting a nonprofit Off-site catering events for an existing permit holder Winery events and tastings tied to a TABC permit

When to Apply

TABC asks you to submit your temporary event application at least 10 business days before the event. File later, and you face late fees and a real risk the permit won’t arrive in time.

Remember, too, that nonprofit and approval-based events need TABC’s go-ahead before you sell or serve anything. A filed application isn’t permission. Once you have the permit, display it where people can see it throughout the event.

If you’ve missed that 10-day window, call your local TABC office right away. Don’t assume you can sell and sort it out later.

How to Get a Temporary TABC Permit

  1. Confirm you qualify. You need a nonprofit’s status or an existing retail permit.
  2. Pick the right authorization. Match NT, TEA, or FUN to your event.
  3. Get the property owner’s approval for the event location.
  4. Complete the application. Use TABC’s temporary permits and events page to find the right form.
  5. Submit at least 10 business days early. Send it to your local TABC office or through AIMS.
  6. Wait for approval before any sales or service.
  7. Display the permit at the event.

Our Alcohol License Acquisition service handles the paperwork when a deadline is tight.

Common Mistakes

  • Assuming a private host can apply for a one-time permit
  • Applying less than 10 business days before the event
  • Selling after filing but before approval
  • Treating a nonprofit’s permit as automatic cover for every vendor at the event
  • Letting an existing license lapse, which kills the temporary authority tied to it

Frequently Asked Questions

Who can get a temporary TABC permit?

Qualifying nonprofits and businesses that already hold a TABC retail permit or license.

Can an individual get a temporary TABC permit for a party?

No. TABC doesn’t issue temporary permits to private individuals without a retailer permit or nonprofit status.

How early do I need to apply?

At least 10 business days before the event to avoid late fees and processing delays.

How long does a nonprofit temporary permit last?

Up to ten consecutive days. Longer events need separate permits.

Can I sell alcohol while my application is pending?

No. Wait for TABC’s approval before selling or serving.

Do I need a temporary permit to give alcohol away free?

Not if it’s genuinely free to any adult who asks, with no donations or cover charge.

Can a new business use a temporary permit before its license arrives?

No. Temporary authority depends on already holding a retail permit.

What if I don’t qualify?

Hire a licensed caterer, work under a qualifying nonprofit’s permit, or use a dry-hire arrangement.

You can get a temporary TABC permit only as a qualifying nonprofit or as an existing permit holder extending to a new location. Everyone else needs a licensed partner. Whatever your path, file at least 10 business days early and wait for approval before you pour.
